Terms and Conditions
1. Scope
1.1 These Terms and Conditions, in the version valid when the order is placed, apply to all orders through our online shop.
1.2 Our online shop is intended for both consumers and businesses.
1.3 A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
1.4 A business is a natural or legal person or a partnership with legal capacity acting, when concluding a legal transaction, in the exercise of its commercial or independent professional activity.
1.5 For businesses, conflicting or supplementary terms of the business become part of the contract only if we have expressly agreed to their application.
2. Contracting party
The purchase contract is concluded with: Weingut Johannes und Gernot Reith GbR, Obere Laugasse 1, 55286 Wörrstadt, Germany, email info@reithwein.com, telephone 06732 / 63976.
3. Subject matter
3.1 Our online shop offers in particular wine, sparkling wine, Secco, grape juice, other beverages, accessories, vouchers and other goods listed in the shop.
3.2 Product displays in the online shop do not constitute a legally binding offer, but a non-binding invitation to place an order.
3.3 Product images, vintages, labels, presentation and packaging may differ from the delivered goods within customary commercial limits, provided that the difference is reasonable for the customer.
3.4 Wine and other natural products may show customary variations, particularly in vintage, colour, taste and sensory expression. Such variations do not constitute a defect where the agreed characteristics are substantially maintained.
4. Conclusion of the contract
4.1 You may initially place goods in the cart without obligation and change your entries at any time before submitting the order using the correction tools provided during checkout.
4.2 By clicking the order button, you submit a binding offer to conclude a purchase contract for the goods in the cart.
4.3 After we receive your order, you receive an automatic order acknowledgement by email. This initially only confirms receipt of the order and does not constitute acceptance of your offer unless it contains our express acceptance under clause 4.4.
4.4 If advance payment has been agreed, the contract is concluded when you receive our email expressly accepting your offer and requesting payment. For other payment methods, the contract is concluded when we accept your offer through an express shipping confirmation or by dispatching the goods.
4.5 We may reject orders where statutory requirements, lack of availability, delivery obstacles or other objective reasons prevent fulfilment.
5. Contract language and storage of the contract text
5.1 The language available for concluding the contract is German.
5.2 We store the contract text in accordance with statutory requirements and send you the order data and these Terms by email.
5.3 The German version of these Terms governs the contract unless mandatory statutory provisions provide otherwise.
6. Prices and shipping costs
6.1 All prices shown in the online shop are total prices in euros and include statutory VAT where applicable.
6.2 Shipping costs are added to the prices unless otherwise stated in the relevant offer.
6.3 The specific shipping costs, any island surcharges and the conditions for free shipping are shown separately during the order process and in the shipping information.
6.4 Where delivery outside Germany is offered, additional country-specific taxes, duties or other costs may arise for cross-border deliveries if they are not already shown during checkout.
7. Payment terms
7.1 The payment methods specifically offered during checkout are available to you.
7.2 These may include advance payment, PayPal, credit card, Klarna, Apple Pay, Google Pay, direct debit, instant bank transfer or purchase on invoice, where offered in the order process.
7.3 We may exclude individual payment methods in a particular case or depending on order value, delivery address, credit assessment or previous payment behaviour.
7.4 For advance payment, the invoice amount must be transferred promptly after you receive the acceptance and payment request email referred to in clause 4.4 to the account stated in that email.
7.5 For purchase on invoice, the invoice amount is due without deduction within 14 days after receipt of the goods and invoice, unless otherwise stated during checkout or on the invoice.
7.6 Payments through third-party providers are additionally subject to their contractual and privacy terms.
8. Delivery, delivery time and restrictions
8.1 Delivery is made to the delivery address entered during checkout.
8.2 Unless otherwise stated for the product, delivery usually takes 3 to 5 working days after conclusion of the contract; for advance payment, the period starts when payment is received.
8.3 During exceptionally high or low temperatures, frost, heat waves or other weather conditions that could affect product quality, we may postpone dispatch for a reasonable period until suitable conditions return. We will inform you promptly.
8.4 Partial deliveries are permitted where reasonable for you.
8.5 We deliver to the areas made available for selection during checkout.
8.6 Delivery to parcel lockers or comparable collection stations may be excluded.
9. Collection
9.1 Where offered in the shop, you may collect goods from our business premises after placing an order.
9.2 We will inform you when the goods are ready for collection.
9.3 Collection takes place by prior arrangement within the stated times.
10. Retention of title
The delivered goods remain our property until payment has been made in full.
11. Protection of minors
11.1 Alcoholic beverages are sold and supplied only in accordance with the applicable statutory provisions on the protection of minors.
11.2 By placing the order, you confirm that you have reached the minimum age required for the ordered goods and that your information is correct.
11.3 We may request suitable proof of age before conclusion of the contract, before dispatch or upon delivery.
11.4 Where there are justified doubts about compliance with age requirements, we may reject the order, postpone dispatch or refuse delivery.
12. Vintages, availability and replacement vintages
12.1 If a particular vintage is no longer available at delivery, we may supply an equivalent subsequent vintage where reasonable for the customer.
12.2 If no equivalent replacement vintage is available, payments already made will be refunded promptly.
13. Vouchers and discount codes
13.1 Promotional vouchers and discount codes may be redeemed only during the stated period and under the communicated conditions.
13.2 Vouchers and discount codes cannot be paid out in cash.
13.3 As a rule, only one voucher or discount code may be redeemed per order unless expressly stated otherwise.
13.4 Gift vouchers are transferable unless expressly agreed otherwise.
14. Right of cancellation
14.1 Consumers have the statutory right of cancellation.
14.2 Details are provided in our separate cancellation policy.
14.3 Businesses are not granted a voluntary right of cancellation.
15. Transport damage
15.1 If goods arrive with obvious transport damage, please complain to the carrier immediately where possible and inform us promptly.
15.2 Failure to make a complaint or contact us does not affect a consumer's statutory warranty rights.
16. Warranty
16.1 Consumers have the statutory rights relating to defects.
16.2 The following additionally applies to businesses: (a) the warranty period is one year from delivery; (b) obvious defects must be reported to us in writing promptly, no later than seven calendar days after receipt; (c) hidden defects must be reported in writing promptly after discovery; (d) for justified defects, we may choose between repair and replacement delivery.
16.3 No warranty applies to damage caused by improper storage or use, natural wear, or changes customary for the product.
17. Liability
17.1 We have unlimited liability for intent and gross negligence, injury to life, body or health, an assumed guarantee and under the German Product Liability Act.
17.2 For slightly negligent breach of essential contractual duties, liability is limited to foreseeable damage typical of the contract.
17.3 Liability is otherwise excluded.
18. Governing law and jurisdiction
18.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
18.2 For consumers, this choice of law applies only insofar as it does not deprive them of protection under mandatory provisions of the state of their habitual residence.
18.3 If the customer is a merchant, a legal entity under public law or a special fund under public law, our registered office is the place of jurisdiction for all disputes arising from contractual relationships between us and the customer, to the extent permitted by law.
19. Alternative dispute resolution
We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.
20. Final provisions
If any provision of these Terms is or becomes wholly or partly invalid, the validity of the remaining provisions remains unaffected.
